As such, Florida Statutes § 849.08 and § 849.16 which makes it a crime to play or engage in any game of chance, at any place, by any device whatever, for money or other thing of value is still in full force as a third degree felony across the State. Further, Florida Statute 849.16 defines illegal slot machines as machine-based games that contain “any element of chance or any other outcome unpredictable by the user.” The implication of this Supreme Court ruling is that even if a business receives its County and City occupational and business licenses to operate the adult arcade business, the business and the responsible owner may still be held criminally liable under Florida State law.
But the story does not end there. Very few of these businesses and owners have been criminally prosecuted. In August 2006 a Broward County Jury awarded a not guilty verdict to an Adult Arcade owner. The jury verdict has no precedence value; however, it has given confidence to many Adult Arcade owners to open their doors. Some Counties, at the discretion of the State Attorneys, have turned to confiscating the machines and forcing closure outside of the criminal court system. Using the criminal statutes, select State Attorneys have employed the civil court system to permit the confiscation of the machines and close the businesses down. For instance, in Let’s of Ocala II, LLC v. Brad King et al., No. 15:2648-CA-G (Fla. Cir. Ct. July 13, 2016) the Court found that the Adult arcade was an illegal operation and sided with the City of Ocala that the Adult Arcade business could be shot down and denied the Adult Arcade’s petition for injunctive relief. The end result was that the business was shot down and the owner lost his investment in about 50 machines.

Businesses should be mindful that every situation and process is different not only from an operational perspective, but even under the current political climate or political motivation of each individual State Attorney for each judicial circuit. The dizzying, intoxicating feeling of 8-bit beeps, sticky floors, and kaleidoscopic, flashing colors reminiscent of an acid trip would take up an entire afternoon and bankrupt a young teen of every quarter he or she owned. And all that money? Money well spent. But things have changed a bit. Contemporary arcades are getting flashier, and redemption games are becoming bigger and more sophisticated. No longer are the quests for tickets to win dollar-store plushies dependent on mechanical pinball-like machines. These are essentially sophisticated gambling machines. Kids love a trip to the arcade, but this could all be because the arcade owners are tapping into vulnerable children and milking them dry — Through gambling. Arcades teaching kids to gamble? No way! Or so I thought. Having recently visited the old arcade at the ripe old age of 23, things are a lot different under my more educated eyes. I would remember the days where I would put between $5 and $20 into a machine, and up to 100 tokens would come out. 100 tokens could get you possibly an hour or so of fun. Sometimes, it was a day to enjoy some senseless violence and beat the living daylights out of your friends in Street Fighter or Tekken. Other days, it was all about who would become the next Richard Petty or Michael Schumacher, disregarding everything you learned in Driver’s Ed in your ultimate quest for first place. But some others, it was all about the tickets. Prize tickets.
Now, these tickets could be redeemed for prizes, many of them looked at religiously by wide-eyed children from below. There were plush animals, basketballs, scooters, candy, and other things. What we as kids didn’t realize was that the nice prizes would cost 5000 tickets or more. And to get that Spongebob plushie (that probably cost the arcade $2), we would spend hundreds of tokens to even come close. But all we wanted was that Spongebob doll. Now, the only way to get tickets was to play the redemption games. Play a game, and depending on your score, get tickets. Some of these games, like the basketball game, would be purely dependent on skill. But you wouldn’t be able to win that many. You could maybe walk out with 10-15 tickets shooting hoops. But right next to the simple basketball machine, you would see a colorful, almost hypnotic flashing of lights. Upbeat music would beckon you to look. Hey kid, at this machine, you could win the jackpot of 800 tickets for only one token!
10-year-old me was hooked on trying to win the jackpot. However, in about 2 minutes, I had already run out of money and had to cash in my hard earned lawn-mowing money for another go. I gave up on that machine, but quickly moved on to another, and then another. Finally, I hit a jackpot and won 470 tickets on a ball-drop game (27th time’s the charm!). Convinced I was some sort of master, I stuck to that game, winning almost nothing. Then it hit me. I could stick with the basketball game to keep on winning the same 10-15 tickets per try, or I could risk it all and try for the jackpots at the ball-drop.
Needless to say, I went with the logical option at 10 years old.
I went for the ball-drop.
